Özet

Kişisel durum sicilinin kamu düzeni gereği doğru şekilde tutulması gerekir. Bu kayıt sisteminin güvenilir nitelikte olmasında kamusal ve özel fayda bulunmaktadır. Kişisel durum sicilinde tutulan veriler aksi ispatlanana kadar doğru kabul edilir. Böylelikle resmi ve özel işlemlere esas teşkil eder. Bu kapsamda, gerçeği yansıtmayan sicil, hatalı işlemlere ve hak kayıplarına neden olabilir. Aslında sicildeki gerçeği yansıtmayan kayıtların düzeltilmesi için çeşitli yollar öngörülmüştür. Fakat bu düzeltme imkanları olsa bile kişilerin zarara uğraması mümkündür. Bu bağlamda kanun koyucu bu sicilin hukuka aykırı tutulmasından doğan zararları Türk Medeni Kanunu’nda özel olarak düzenlemiştir. İdare bu tür zararlardan sorumluluğu doğrudan üstlenmiştir. Devlet, özünde kamusal bir hizmet olan kişisel durum sicilinin tutulmasıyla ilgili sorumluluğunu esas itibarıyla özel hukuka tabi kılmaktadır. Bu karma bir sorumluluk rejimine neden olmaktadır. Sorumluluk türü kusursuz sorumluluktur. Devletin sorumluluğunun doğabilmesi için sicilin hukuka aykırı şekilde tutulması ile meydana gelen zarar arasında uygun illiyet bağı bulunmalıdır. Zarara uğrayan kişi bu şartlar sağlandığında maddi ve/veya manevi zararının tazminini talep edebilir. Eğer sicilin tutulmasında görevli kişinin zararın oluşmasında kusuru bulunuyorsa, Devlet ödediği tazminatı ilgili personeline rücu etme hakkına sahiptir.
The civil status register must be maintained accurately in compliance with public order. The reliability of this system serves both public and private interests. The entries in the civil status register are presumed accurate until rebutted and therefore serve as the foundation for both official and private transactions. In this context, a register that does not reflect the truth may lead to erroneous transactions and loss of rights. However, even where such correction mechanisms are available, individuals may still suffer damage. In this context, the legislator has expressly provided in the Turkish Civil Code for liability for damages arising from the unlawful maintenance of the civil status register. The administration bears direct responsibility for such harm. The State essentially subjects its liability concerning the maintenance of the civil status register, which is in substance a public service, to private law. This gives rise to a mixed liability regime. The type of liability is strict liability. For the State to incur liability, a causal link must exist between the unlawful maintenance of the register and the damage sustained. Where these requirements are satisfied, the injured party may seek compensation for both pecuniary and non-pecuniary losses. Moreover, if the public official responsible for maintaining the register is at fault, the State is entitled to recourse against that official for the amount of compensation paid.
