Although refugee law is a field that has existed throughout human history and has continuously evolved, many concepts in this field still require clarification. One such concept is the ground of “membership in a particular social group” found in Article 1 of the 1951 Convention Relating to the Status of Refugees (the Convention), under the section titled General Provisions. The concept of “membership in a particular social group” is rarely encountered outside the text of the Convention, and the Convention itself does not specify which groups fall within this category. A particular social group usually consists of individuals sharing a common historical background, habits or social status. In this study, the purpose of addressing the concept of “particular social group” within the scope of the Convention will be examined, with reference to court decisions aimed at concretizing the concept, as well as the approaches and methods adopted in practice. In this context, the criteria used in defining particular social groups and the evaluation of their protection needs will also be elaborated in detail.
Mülteci hukuku, insanlık tarihi boyunca var olmuş ve sürekli olarak gelişim göstermiş bir alan olmasına rağmen bu alanda halen açıklığa kavuşturulmayı bekleyen pek çok kavram bulunmaktadır. Bu kavramlardan biri, 1951 tarihli Mültecilerin Hukuki Durumuna İlişkin Sözleşme’nin (Sözleşme) Genel Hükümler başlıklı 1. maddesinde yer alan “belirli sosyal gruba mensubiyet” nedenidir. “Belirli sosyal gruba mensubiyet” kavramı Sözleşme metni dışında pek sık rastlanılmayan ve Sözleşme içerisinde de hangi grupların bu kategoriye gireceğinin belirtilmediği bir kavramdır. Belirli bir sosyal grup, genellikle ortak tarihi geçmişe, alışkanlıklara veya sosyal statüye sahip bireylerden oluşmaktadır. Bu çalışmada, “belirli sosyal grup” kavramının Sözleşme kapsamında ele alınış amacı, kavramın somutlaştırılması için mahkeme kararlarına yer verilecek, uygulamada benimsenen yaklaşım ve yöntemler incelenecektir. Bu bağlamda, belirli sosyal grupların tanımlanması sürecinde kullanılan kriterler ve bu grupların korunma ihtiyaçlarının değerlendirilmesi de detaylandırılacaktır.
