TÜRKİYE’DE MAĞDUR HAKLARI İLE İLGİLİ KURUMSAL YAPI VE YENİ HİZMET MODELLERİ

Özet

Ceza usul hukuku, uzun yıllar sadece sanıkla ilgilenmiştir fakat yirminci yüzyılın ikinci yarısından itibaren mağdur haklarını da inceleme konusu yapmıştır. Yirmibirinci yüzyıla gelindiğinde, mağdu- run haklarının korunması yönündeki görüş ağırlık kazanmıştır. Ülke- mizde de 01.6.2005 tarihinden itibaren adalet sistemimizde yapılan geniş kapsamlı yasal değişikliklerle dünyada bu alandaki gelişmelere paralel olarak mağdur haklarına önem verilmeye başlanmıştır. Bu çalışmada; mağdur hakları bağlamında Türkiye’de 2010 yı- lından itibaren faaliyete geçen çocuk izlem merkezlerinin hangi paydaş kurumlarla, ne tür işbirliği içerisinde olduğu, bu merkezlerin işleyişinde karşılaşılan sorunlar belirtilerek bu modelin işleyişinde ve geliştirilmesinde yararlı olabileceği düşünülen hususlara değinilmiş- tir. Keza ülkemizde 2017’den bu yana adalet sisteminin önemli bir kurumsal bileşeni olarak öne çıkan adli görüşme odaları uygulama- sı, adli süreç boyunca mağdurların korunmasını ve muhtemel ikincil mağduriyetlerin önlenmesini amaçlamaktadır. Yine Yüksek Öğretim Kurulu kararı ile bazı üniversitelerin bünyelerinde oluşturulan ço- cuk koruma merkezleri, mağdurların korunmasına yönelik kurum- sal anlamda yeni hizmet modellerinden birisi olarak çalışmada ele alınmıştır. Adalet Bakanlığı’nca üzerinde çalışmaları devam eden ve hâlihazırda sadece Erzurum’da, Bursa’da ve Eskişehir’de faaliyetleri- ni yürüten çocuk adalet merkezleri ise, çocuklara yönelik bütün adli işlemlerin çocuk dostu usullerle tek çatı altında yapılmasını hedefle- mektedir. Hiç şüphesiz günümüzde çocuk izlem merkezleri, adli görüş- me odaları, çocuk koruma merkezleri ve çocuk adalet merkezleri uygulamaları ile ilgili olarak alanyazında daha fazla çalışmaya ihtiyaç duyulmaktadır. Bu çalışmanın amacı; Türkiye’de mağdur hakları ile ilgili genel bir bilgilendirme ile birlikte, mağdur hakları ile ilgili kurum- sal yapıyı ve yeni hizmet modellerini -işleyiş süreçleri ve amaçları ile birlikte- tanıtmak ve uygulamada karşılaşılan sorunları dile getirerek çözüm önerilerinde bulunmaktır.
For many years, criminal procedural law has only dealt with the accused, but since the second half of the twentieth century, it has also examined the rights of the victim. In the twen- ty-first century, the view of protecting the rights of the victim has gained importance. In our country, with the comprehensive legal amendments made in our justice system since June 1, 2005, victim rights have started to be given importance in parallel with the devel- opments in this field in the world. In this study; within the context of victims’ rights, which stake- holder institutions and what kind of cooperation the child monitor- ing centres operational since 2010 in Turkey, have with them, the problems encountered in the functioning of these centres, and the issues that are considered useful for the functioning and develop- ment of this model are mentioned. Likewise, the practice of judicial interview rooms, which has come to the fore as an important insti- tutional component of the justice system in our country since 2017, aims to protect victims during the judicial process and to prevent possible secondary victimisation. Again, the child protection cen- tres established within some universities with the decision of the Council of Higher Education are discussed in the study as one of the new service models in the institutional sense for the protection of victims. On the other hand, the juvenile justice centres, which are being worked on by the Ministry of Justice and which are currently operating only in Erzurum, Bursa and Eskişehir, aim to carry out all judicial procedures for children under a single roof with child-friend- ly procedures. Undoubtedly, there is a need for more studies in the litera- ture on the practices of child monitoring centres, forensic interview rooms, child protection centres and juvenile justice centres. The aim of this study is to provide general information about victims‘ rights in Turkey, to introduce the institutional structure and new service models related to victims’ rights - together with their functioning processes and purposes - and to suggest solutions by expressing the problems encountered in practice.
